TERMS OF SERVICE

These Terms of Service govern the use of rcgaragex.com and purchases from Lunivon Limited, trading as RCGarageX.

By using the website or placing an order, the customer agrees to these Terms and our Shipping Policy, Return Policy, Warranty Policy, and Privacy Policy.

About RCGarageX

RCGarageX is operated by Lunivon Limited, a company registered in England and Wales under company number 16683696. Our registered office is 5 Brayford Square, London E1 0SG, United Kingdom.

We do not present RCGarageX as a U.S.-registered company. We provide RC enthusiasts with access to selected vehicles, replacement parts, performance upgrades, tools, and accessories sourced from manufacturers and suppliers around the world.

Orders are fulfilled through our international cross-border network and shipped to customers in the United States and other supported countries.

Eligibility

Customers must be at least 18 years old or the age of legal majority in their jurisdiction to place an order.

A minor may use the website only under the supervision of a parent or legal guardian. The adult placing the order is responsible for product selection, safe use, and appropriate supervision.

Customer Information and Accounts

Customers must provide accurate payment, billing, shipping, and contact information.

Customers are responsible for protecting account passwords and for activity conducted through their account, except where unauthorized activity results from a security failure attributable to RCGarageX.

Product Information

We make reasonable efforts to provide accurate descriptions, specifications, photographs, dimensions, colors, materials, and compatibility information.

Minor differences may occur because of manufacturing updates, production batches, photography, lighting, or screen settings.

We may update product information when a manufacturer changes a specification. We will not materially change an accepted order without the customer’s agreement.

Compatibility

Customers must review the model, scale, version, wheelbase, part number, dimensions, voltage, connector, radio protocol, firmware, and installation requirements before purchase.

“Compatible with” means that a product is intended for use with the identified platform under the conditions described. It does not mean that the product is manufactured, authorized, sponsored, or endorsed by the referenced brand.

Third-Party Trademarks

References to third-party manufacturers, vehicles, models, and RC platforms are used only to identify compatibility.

Unless expressly stated otherwise, aftermarket products sold by RCGarageX are not manufactured, authorized, sponsored, endorsed by, or affiliated with the owners of the referenced trademarks.

All third-party trademarks and product names belong to their respective owners.

Prices and Payments

Prices are displayed in the currency selected on the website. Currency conversions may be estimates. A customer’s bank or payment provider may apply its own exchange rate or fee.

Shipping charges, taxes, and disclosed import charges are shown before payment where reasonably practicable.

Payment must be authorized by the customer or lawful payment account holder. Payments may be processed by Shopify Payments, PayPal, or another approved provider.

Pricing and Listing Errors

We may correct typographical, pricing, availability, or promotional errors before accepting an order.

If an error affects an order already submitted, we will contact the customer and offer the choice to confirm the corrected order or receive a full refund.

Order Acceptance

An order confirmation confirms that we received the order. It does not necessarily mean the order has been finally accepted.

We may reject or cancel an order before dispatch because of:

• Stock or availability errors.

• Payment failure.

• Suspected fraud.

• Incorrect pricing or product information.

• Legal or shipping restrictions.

• Product safety concerns.

• Sanctions or trade restrictions.

• Inability to deliver to the address provided.

If we cancel an order after payment, we will refund the amount charged for the canceled product and any related shipping charge.

Shipping and Delivery

Shipping is governed by our Shipping Policy.

If we cannot ship within the promised processing period, we will notify the customer and provide the legally required choice to accept the delay or cancel the affected unshipped product for a refund.

Risk of physical loss normally transfers to the customer upon confirmed delivery, except where applicable law provides otherwise. This does not prevent legitimate claims for carrier loss, concealed damage, or unauthorized delivery.

Returns and Warranties

Returns are governed by our Return Policy. Product defects are governed by our Warranty Policy and any applicable manufacturer warranty.

These policies do not limit consumer rights that cannot legally be excluded.

RC Product Safety

RC vehicles, batteries, chargers, motors, electronics, tools, and performance parts can cause injury, fire, property damage, or product failure if used incorrectly.

Customers must:

• Read and follow product instructions and warnings.

• Confirm compatibility before installation.

• Use the correct battery, charger, voltage, polarity, and connector.

• Operate products in a safe and lawful location.

• Keep away from people, animals, traffic, airports, power lines, and restricted areas.

• Provide appropriate adult supervision.

• Stop using damaged, swollen, leaking, overheated, or malfunctioning products.

• Follow applicable aviation, radio, battery, vehicle, and local safety laws.

Performance modifications may increase speed, heat, load, wear, and failure risk and may affect a manufacturer warranty.

Reviews and Customer Content

Customers may submit reviews, photographs, videos, comments, and other content.

By submitting content, the customer confirms that they own it or have permission to provide it and that it is accurate, lawful, and does not infringe third-party rights.

The customer grants Lunivon Limited a non-exclusive, worldwide, royalty-free license to display, reproduce, adapt, and use submitted content for operating and promoting RCGarageX, subject to applicable privacy and advertising laws.

We may remove unlawful, abusive, misleading, irrelevant, or infringing content. We do not promise to publish every submission.

Acceptable Use

Customers may not use the website to:

• Violate applicable law.

• Commit fraud or payment abuse.

• Infringe intellectual property rights.

• Submit false information.

• Introduce malware.

• Interfere with website security.

• Scrape or commercially reproduce substantial website content.

• Impersonate another person.

• Purchase products for unlawful use.

Intellectual Property

Original RCGarageX branding, photographs, text, graphics, guides, videos, website design, and software are owned by or licensed to Lunivon Limited.

Website content may be used for personal shopping and informational purposes. It may not be commercially copied, distributed, or exploited without written permission.

Third-Party Services

The website may rely on Shopify, payment processors, carriers, manufacturers, social platforms, and other third-party providers.

We are not responsible for independent third-party websites or services. This does not remove obligations we have as the seller.

Website Availability

We do not guarantee uninterrupted or error-free website access. Access may be temporarily suspended for maintenance, security, legal compliance, or circumstances beyond our control.

Disclaimer

Except for our written Limited Warranty and rights that cannot legally be excluded, the website and services are provided on an “as available” basis.

We do not guarantee that every product will achieve a particular performance result in every vehicle, setup, or environment.

Nothing in these Terms excludes a warranty or consumer remedy that applicable law prohibits us from excluding.

Limitation of Liability

To the maximum extent permitted by law, Lunivon Limited is not liable for indirect, incidental, special, consequential, or punitive damages, loss of profit, loss of data, or damage caused by misuse, incompatible installation, unauthorized modification, crashes, competition, or failure to follow product instructions.

Where liability may lawfully be limited, our total liability arising from an order or product will not exceed the amount paid for that order or product.

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, willful misconduct, or liability that cannot legally be excluded.

Force Majeure

We are not responsible for delays caused by events reasonably beyond our control, including severe weather, natural disasters, war, government action, customs disruption, labor disputes, carrier failure, cyberattack, factory shutdown, epidemic, or transportation interruption.

This provision does not remove a customer’s right to cancel and receive a refund where required by law.

Governing Law and Disputes

Customers are encouraged to contact support@rcgaragex.com before starting formal proceedings so we can try to resolve the issue.

These Terms are governed by the laws of England and Wales, without excluding mandatory consumer protections applicable in the customer’s state or country of residence.

Courts with lawful jurisdiction may hear disputes. Nothing in these Terms requires a U.S. consumer to waive a non-waivable federal or state right.

These Terms do not require binding arbitration or a class-action waiver.

Severability

If one provision is found unenforceable, the remaining provisions remain effective.

Failure to enforce a provision on one occasion does not waive the right to enforce it later.

Changes to These Terms

We may update these Terms to reflect changes in our business, services, or legal obligations.

The version displayed when an order is placed normally governs that transaction unless a change is required by law or accepted by the customer.
